VENDOR TERMS & CONDITIONS
Please read before submitting your application
1) A Curated Market - Submission of an application does not guarantee acceptance.
OH-BOY! Market is a juried and curated event. Because we aim to create a balanced marketplace, not every application can be accepted. If an application is not selected, it is not a reflection of the quality of the work, but rather how it fits within the overall curation of the market.
2) Participation Agreement
Submission of an application, acceptance by OH-BOY! Market, and payment of the vendor fee together form an agreement for the use of a vendor booth space.
OH-BOY! Market reserves the right to adjust booth placement, spacing, or layout as needed for safety, logistics, or the overall market experience.
3) Products & Authentic Work
Vendors must sell work that they design, produce, or significantly alter themselves.
Mass-produced resale goods, wholesale imports, or drop-shipped products are not permitted unless approved in advance.
Products sold at the market should match those represented in the vendor’s application.
4) Securing Your Booth
Vendor fees must be paid within 48 hours of acceptance.
Spaces are not guaranteed until payment has been received.
Vendor fees support market production, staffing, marketing, and infrastructure.
5) Cancellations
Vendor fees are non-refundable.
Booth spaces may not be transferred, shared, or resold without written approval from OH-BOY! Market.
Vendors who fail to arrive during the designated load-in window may forfeit their space.
6) Weather & Unforeseen Circumstances
OH-BOY! Market is typically a rain-or-shine event.
However, organizers may modify or cancel the event if conditions arise that impact safety or operations, including severe weather, government restrictions, venue issues, or other unforeseen circumstances.
If this occurs, vendor fees may be applied to a future OH-BOY! Market event at the organizers’ discretion.
7) Load-In, Setup & Market Hours
Vendors must arrive during the designated load-in window and be fully set up before the market opens.
Booths must remain open and staffed for the entire duration of the event.
Early breakdown is not permitted without approval from organizers.
Vendors are responsible for leaving their booth area clean at the end of the event.
8) Booth Setup & Safety
Vendors are responsible for their own booth setup, including tables, displays, and tents if needed.
For outdoor events, tents must be properly secured with weights (minimum 40 lbs per leg). Stakes may only be used if permitted by the venue.
Displays must remain within the assigned booth space and should not obstruct walkways or neighboring vendors.
OH-BOY! Market encourages vendors to create booths that reflect the thoughtful, design-forward atmosphere of the market.
9) Booth Assignments
Booth locations are assigned by OH-BOY! Market and may change as needed for event planning or safety.
Electricity or other utilities are not guaranteed unless arranged in advance.
10) Sound, Music & Generators
To maintain a comfortable market environment, vendors may not use amplified sound or music without prior approval.
Gas-powered generators may only be used with permission from organizers and must not create excessive noise or fumes.
OH-BOY! Market reserves the right to restrict equipment that disrupts nearby vendors or the overall atmosphere.
11) Vendor Conduct
OH-BOY! Market aims to foster a respectful and welcoming environment.
Organizers reserve the right to remove any vendor whose behavior, products, or activities are disruptive, unsafe, or inconsistent with the values of the market.
12) Photography & Promotion
Photography and video may be captured during the event.
By participating, vendors grant OH-BOY! Market permission to use images of their booth, products, or participation for promotional purposes.
Vendors are encouraged to help promote the market through their own channels when possible.
13) Venue Care
Vendors must not damage venue property or infrastructure.
Any damage caused by a vendor’s equipment or activities will be the responsibility of that vendor.
14) Liability
Vendors participate at their own risk.
OH-BOY! Market, its organizers, staff, partners, and venue hosts are not responsible for loss, theft, damage, or injury related to vendor participation.
Vendors are responsible for their property, equipment, and activities during the event.
Proof of liability insurance may be required depending on venue requirements.
15) Solicitation
Promotional materials and sales activity must remain within the vendor’s booth space.
Solicitation by non-participating businesses or individuals is not permitted.
16) Updates to These Terms
OH-BOY! Market reserves the right to make reasonable updates to these guidelines as needed to support the safe and successful operation of the event.
17) Governing Law
These terms are governed by the laws of the State of New York.
